These Terms of Use (referred to as the "Agreement") govern your access to and use of the Tuxedo websites, mobile sites, and applications (collectively, "Tuxedo Sites") as well as the content, features, and services ("Services") provided by Tuxedo. In this Agreement, "Tuxedo" and "we" refer to the company offering the Services, and "User," "Users," and "you" denote any entity interacting with the Services or related platforms. This Agreement includes Tuxedo's standard policies, procedures, and terms and conditions referenced herein (collectively, "Tuxedo Policies").

By accessing the Services or clicking "accept" or "agree," you affirm that you have read, understood, and agreed to be bound by this Agreement. Additionally, you represent that you are of legal age and not prohibited by law from using the Services. This Agreement encompasses important provisions; therefore, careful consideration is advised.

Tuxedo reserves the right to update or revise this Agreement periodically, and your continued use of the Services implies acceptance of any modified version. It is your responsibility to review this Agreement regularly. Failure to agree with the terms, or any modifications, requires termination of your use of the Services, resulting in the loss of access to your Account.

Part I - Reservation Services

1. Restaurant Reservations: Tuxedo provides restaurant reservation services on the Tuxedo Sites, assisting Users in securing dining reservations or joining waitlists at participating third-party restaurants ("Restaurants"). The Reservation Services and Waitlist Services facilitate Users' requests through Tuxedo Sites, connecting with the Restaurant's reservation database. Confirmations, updates, and cancellations are communicated to Users through email or other agreed electronic means.

2. No-Show Policy: Users agree to cancel reservations at least 24 hours in advance. Failure to do so, or a no-show, may result in charges, and Tuxedo is not liable for any such charges. Users receive no-show notifications by email.

3. Tuxedo Dining Rewards: Residents of specific countries may participate in Tuxedo's rewards program, subject to the Tuxedo Dining Rewards Terms and Conditions.

4. Usage Guidelines: Users commit to using Reservation and Waitlist Services responsibly, honoring reservations, and not engaging in deceptive practices, including simultaneous reservations or joining waitlists that would lead to simultaneous reservations.

Part II – Terms for All Services

1. Privacy Policy: Refer to our privacy policy for information on how we collect, use, and disclose data.

2. Your Account: Creating an Account is optional but required for using Payment Services. Users must provide accurate information and promptly update it. Users are responsible for Account confidentiality and usage.

3. Communications from Tuxedo: Tuxedo may communicate through electronic messages, including email, text, or mobile push notifications, as outlined in our Privacy Policy.

4. Technical Requirements: Services require internet access, and Users are responsible for associated charges. Some features may require JavaScript.

5. Modifications to Services: Tuxedo reserves the right to modify Services without notice. Users who object to changes must cease using the Services.

6. Intellectual Property Rights and Grant of Rights to User: The Services' features, information, and materials are protected by intellectual property laws. Users are granted a non-exclusive license to use Tuxedo mobile applications.

7. Application License: Subject to this Agreement, Users receive a non-transferable license to use Tuxedo mobile applications.

8. Use Restrictions: Services are for personal use only, and Users must not engage in prohibited activities. Tuxedo reserves the right to refuse service or terminate Accounts.

9. Termination: Tuxedo may suspend or terminate Services without notice for violations of this Agreement. Termination may result in the loss of access to accumulated dining points.

10. Reviews, Comments, Communications, and Other Content: Users may submit content, subject to guidelines. Tuxedo may monitor, edit, or remove User Content, and Users grant Tuxedo a license to use submitted content.

11. Liability Limitations: Tuxedo Parties are not liable for damages arising from this Agreement, Services use, or Restaurant/Merchant performance. Certain limitations may not apply to residents of the United Kingdom or European Union.

12. Disclaimer of Warranties: Use of Services is at the User's risk, and Tuxedo does not guarantee uninterrupted or error-free Services. Services, Tuxedo Content, and other materials are provided "as is," and Tuxedo disclaims all warranties.

13. Third-Party Websites, Applications, and Services: Services may contain links to third-party sites, and Tuxedo is not responsible for their content. Third-party beneficiaries are subject to their terms of service.

14. Severability: If any provision is found invalid, the Agreement remains in effect without the invalid provision.

15. Assignment: This Agreement may not be transferred by Users but may be transferred by Tuxedo.

16. Waiver: Waiver of any provision does not create an expectation of non-enforcement.
